Belarusian conscientious objector has won a decisive court case in Lithuania

Today, I am thrilled to share some excellent news: a Belarusian conscientious objector, Vitaly Dvarashin, has won a decisive court case in Lithuania, overturning a deportation order and removing him from Lithuania’s list of national security threats. This victory is monumental not only for Vitaly but also for the broader fight for justice and human rights of Belarusian conscientious objectors.

A Belarusian conscientious objector Vitaly, who had been listed as a potential national security threat due to his studies at a military academy at the age of 16 and subsequent military service in 1998, faced a perilous situation. Lithuania’s Migration Department attempted to deport him to Belarussian prison. At one point, Lithuanian authorities even came to his home to detain him and take him directly to the border.

The Lithuanian Department of National Security argued that it possessed classified evidence supporting its claims that Vitaly posed a threat, possibly even alleging ties to the KGB. However, during the court proceedings, the judge demanded these so-called "secret documents" be presented. When the department failed to produce any evidence, the judge sided with Vitaly, ruling to cancel his deportation and remove him from European security threat databases.

This case underscores the lack of concrete evidence behind the claims of national security threats towards Belarusians. It also highlights how vital it is to challenge such accusations through legal channels.

I want to thank you because as you remember you generously funded Vitaly’s legal representation. The participation of a skilled lawyer was instrumental in securing this outcome.

It’s important to note that this is a victory at the first court instance, and there is a high likelihood that Lithuania’s Migration Department and Department of National Security will appeal the decision. However, this initial win provides hope and inspiration for others in similar situations. It demonstrates that justice can prevail, even in the face of significant challenges.

For now, Vitaly can breathe a little easier, knowing that he will not be abruptly seized and deported to Belarus, where he would face prison and potential torture. This is a critical milestone in ensuring his safety and a powerful reminder of the impact solidarity and collective action can have.
